These Terms of Service ("Terms") govern your access to and use of the Check EFI marketing website at checkefi.com (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

The Site provides general information about Check EFI's check and ACH verification services. You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, or misuse any forms or contact channels (including submitting false, spam, or malicious content).

2. The verification portal

Access to the Check EFI application at app.checkefi.com, including any verification, API, or processor services, is provided under a separate agreement between Check EFI and your organization. These Terms cover only the marketing Site.

3. Intellectual property

The Site and its content — including text, graphics, logos, and the Check EFI name and marks — are owned by Check EFI or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written permission, except for your own internal, non-commercial evaluation.

4. No warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Information on the Site is for general purposes and does not constitute legal, financial, or compliance advice.

5. Limitation of liability

To the fullest extent permitted by law, Check EFI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site, even if advised of the possibility of such damages.

6. Third-party links

The Site may link to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices, and linking does not imply endorsement.

7. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy.

8. Governing law

These Terms are governed by the laws of the United States and the state in which Check EFI is organized, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located there for any dispute arising from these Terms or the Site.

9. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted with an updated "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance.
